TERMS AND CONDITIONS

PHOTOSHOOT CONTRACT, RELEASE OF LIABILITY, WAIVER OF CLAIMS

(“we”, “us”, “our”)

Welcome to Château de Gudanes (“the Château”).

We hope that you will enjoy your time with us.

It is a condition of entry to the Château, for a photographic and/ or film shoot, that you read and agree to comply with the terms of this letter, which sets out our policies concerning your participation.

1. Company Details: In order for us to process your booking, please provide us with your full company name and details of a person of contact for the booking.

2. Deposit: You are required to pay Château de Gudanes a deposit of 50% of the total booking to confirm your reservation. The deposit is non-refundable. YOU WILL NEED TO REQUEST ANY REFUNDS THROUGH YOUR INSURANCE.

3. Payment: You are required to pay the full balance to Château de Gudanes on an agreed upon date before your arrival. The final balance is non-refundable. YOU WILL NEED TO REQUEST ANY REFUNDS THROUGH YOUR INSURANCE.

4. Late payment: If the full balance is not received by the due date, Chateau de Gudanes reserves the right to cancel your reservation and retain the deposit.

5. Cancellation by Château de Gudanes: If for some reason, your shoot needs to be cancelled, Château de Gudanes will offer a full refund (inclusive of the deposit). We are not responsible for any incidental expenses that you may have incurred as a result of your booking such as visas, insurances, vaccinations or non-refundable flights.

6. Behaviour: You are expected to behave in a manner that is respectful and considerate of Château staff and the Château itself.

7. Safety: You acknowledge that the Château’s facilities are limited and basic in keeping with our philosophy of experiencing an 18th Century château. Most rooms in the Château have limited or no electricity. It will be necessary for you to carry a torch with you when it is dark. You agree to act in a responsible manner around candles, and ensure that open flames are not left unattended and that candles are placed in a safe place at all times.

8. Assumption of risks: The Château is undergoing extensive and ongoing restoration work. You acknowledge that it is not possible to discontinue this work during the course of your visit. This means that parts of the Château and its grounds may be hazardous and dangerous. You further acknowledge that you are entering the Château and its grounds at your own risk. Please exercise care and caution, it is recommended you wear closed in shoes.

9. Personal effects: You acknowledge that your personal belongings are not locked and that it is your responsibility to ensure that you keep valuable items with you at all times. Château de Gudanes is not responsible for any loss or damage that occurs to your belongings.

10. Photography & Videography:

10.1 You are permitted to capture photographs and film of the Château as the setting for the photography and/ or videography shoot made in the booking. We are unable to grant you permission to licence any other photoshoots or video shoots during your stay. We are unable to grant you permission to take photographs and / or film for future use, and / or collaborative photoshoots and/ or photos and / or film for other brands/ companies.

10.2 Apart from the taking of official photographs and film to be used for the specific shoot for your reservation, you may take photographs of the Château and the Château’s grounds for your personal use only. Personal use includes uploading the photographs onto your personal social media sites (strictly Facebook and Instagram only) provided that you and/or others do not make any financial or material gain from your accounts on these platforms and/ or from the photographs themselves. You are not permitted to sell, license or use the photographs for any other purpose. You are not permitted to upload photographs to any social media or websites of a commercial nature.

10.3 The stables and residences located at the entrance to the Château do not form part of the Château’s grounds. We are unable therefore to grant you permission to take photographs and / or film of these buildings.

10.4 Photography and film for the purposes of this agreement, includes recording images on any medium including without limitation on mobile phones, iPads and all other electronic devices.

10.5 Permission must be sought from anyone that you wish to photograph and / or film within the grounds of the Château including our team members, contractors, consultants and members of the public.

11. Errors & omissions: Although we have made a concerted attempt to verify the accuracy of statements made in our booking documents; we cannot be held responsible for any error, omission or unintentional misrepresentation that may occur.

12. Acceptance of risk: In consideration of you being permitted to enter the Château and its grounds, you hereby assume all risk of illness, accident and all risk of personal injury (including death) to yourself and to your personal property, sustained whilst you are in the Chateau and its grounds and you and your heirs, executors, administrators, personal representatives and assigns hereby release us and our directors, officers, and employees from any and all liability whatsoever for any loss, personal injury (including death) or property damage which you may suffer whilst in the Château and its grounds.

13. Breach of these terms and conditions: Château de Gudanes reserves the right, at its sole discretion, to take appropriate action should these terms be breached. Château de Gudanes will not refund payment or accept any consequential liability damages or loss. You will be asked to leave the shoot and grounds of the property in the event of any breach of these terms and conditions is made whilst onsite.

14. Agreement: You hereby agree to hold harmless and indemnify us, our directors, officers, employees, licensees, agents, assigns and successors against any and all claims, actions, proceedings, demands, liability, costs, losses, damages and expenses resulting from or by reason of any claim arising from a breach of any of your representations, agreements and undertakings made by you in this letter agreement.

15. Applicable by law: This agreement shall be governed by, and construed in accordance with, the laws of England and Wales, whose courts shall be the courts of exclusive jurisdiction.

I confirm that I have read and understand this agreement prior to accepting it, and I am aware that by accepting this agreement I am waiving certain legal rights which I or my heirs, next of kin, executors, administrators, assigns and representatives may have against Château de Gudanes.
